Establishment and Reason of the foundation Adivasi Buddhijeewi Manch
- The ABM was created in early 2001 to achieve the target and preamble of the constitution and under the provisions of The Constitution of India
- The Part IX of the constitution (relating to Panchayat Raj) & part IXA of the Constitution (relating to the municipalities in Fifth Schedule Areas ) In the constitution under article 241 (i) by the following state Andhra Pradesh, Chhattisgarh, Gujarat, Himachal Pradesh, Jharkhand, Madhya Pradesh, Maharashtra, Odisha, Rajasthan, and Telangana.
- Under Sixth Schedule Areas under article 244 (ii) following Assam, Meghalaya, Tripura, and Mizoram.
- After the amendment in the constitution by 73rd & 74th amendment.
- Thereafter the parliament passed a special law under Article 243M(4)(b) of the Indian Constitution allows Parliament to extend the provisions of Part IX (Panchayats) to Scheduled Areas and Tribal Areas, with exceptions and modifications, without such law being considered an amendment of the Constitution.
- The Provisions of the Panchayat (Extention to the Shedule Areas) Act 1996, and hence assented to by the Hon’ble president of India on 24th December 1996, extending the Part IX of the constitution to the Schedule Areas.
- Subject to such exceptions and modification as have been specified in such laws as no such law shall be deemed to be an amendment of the constitution for the purpose of under article 368
- In addition to this reservation and employment, reservation and promotions, reservation in education sectors should be accommodated for all the reserved categories as declared under the constitution of India.
- The Organization was established to protect and safeguard and preserve the traditions and customs of the people, their cultural identity , community resources and customary mode of dispute resolution also to establish Tribal Autonomy in Fifth where the Schedule Tribe people is living since long. Hence the real owners of the Fifth Schedule Areas and Tribal Areas.
